To celebrate the organisation’s 60th Anniversary, The LMAA is pleased to present together with Shanghai Maritime University a series of 3 webinars. The 3rd webinar will be held at 1400pm (Beijing time) on 29 September 2020 (Tuesday) and the theme is the Practical Aspects of Arbitrating in 2020. The agenda is as follows:
14:00-14:30 Online registration
14:30-14:50 Ian Gaunt, former President of LMAA, speaker and moderator, will consider progress made so far in organising virtual hearings, the LMAA Guidelines for Virtual Hearings and the long term impact on London arbitration of the measures introduced since the COVID lockdowns. Ian is a full time maritime arbitrator and former President of the London Maritime Arbitrators Association. He has been involved as arbitrator in a significant number of shipping cases many of which have involved PRC companies. He is co-author of The Law of Shipbuilding Contracts (5th edition, published in May 2020).
14:50-15:10 David Martin-Clark, full time arbitrator of LMAA, will explain how a partial final award on a preliminary issue can be an effective means of case management and give examples of the type of issues typically determined by such awards. His presentation will set out the procedure to be followed in obtaining an Award on a preliminary issue and the relative powers in this regard of the parties and the tribunal. It will also cover the essential characteristics of such awards, including the question of costs. It will finally offer some guidance on the circumstances in which an award on a preliminary issue is better avoided. David is a full time arbitrator and past committee member of the London Maritime Arbitrators Association. After obtaining a degree in law and qualifying as a barrister, he was engaged in the management of a leading P&I and Defence Club. In addition to arbitrating in London, he arbitrates in Hamburg, as a member of the German Maritime Arbitrators Association and in Singapore, as a panelist of the Singapore International Arbitration Centre and of the Singapore Chamber of Maritime Arbitration. He is also a panelist at the Hong Kong International Arbitration Centre and a member of the CMAC.
15:10-15:30 Nevil Phillips, barrister at Quadrant Chambers in London. His presentation will consider the relatively strict approach of English law to the need for compliance with the requirements of demurrage time-bar clauses and the effect of non-compliance with the same. Three recent decisions of the English Commercial Court illustrate this approach, and demonstrate how finely-balanced the outcome may sometimes be. The presentation will address the principles which arise from these decisions and emphasise the need to be alert to provisions requiring the prompt provision of documents in support of a claim in the context of arbitration under English law. Nevil’s practice covers all aspects of commercial and shipping advisory and advocacy work, encompassing the broadest spectrum of commercial, international trade, commodities, shipping, maritime, shipbuilding, ship sale, energy, insurance, finance, and jurisdictional disputes and associated areas and remedies. He appears regularly in commercial arbitration (both domestic and international, with experience before a wide variety of arbitral institutions, bodies and trade associations, including LMAA, GMAA, LCIA, ICC and associated bodies), the Commercial Court, and the appellate courts.
15:30-15:40 Q&A (Nb. webinar will be recorded)
